DEVOLUTION OF PERSONNEL FUNCTIONS TO LEGAL SERVICE PERSONNEL BOARDS WITH EFFECT FROM 1 DECEMBER 2007

New Article 111AA on the Personnel Boards for the Legal Service

The Constitution of the Republic of Singapore (Amendment) Act 2007 introduced the new Article 111AA on the Personnel Boards for the Legal Service.

2 Under Articles 111AA(1), (2) and (8), the President approved the establishment of two Personnel Boards for the Legal Service with effect from 1 December 2007 : the Legal Service Senior Personnel Board and the Legal Service Special Personnel Board.

3 Upon the establishment of the re-constituted Personnel Boards, the powers and functions of the LSC were devolved to the Personnel Boards except the power to dismiss and exercise disciplinary control over all Legal Service Officers (“LSOs”), and all powers over LSOs of and above a certain “threshold grade”.

4 The powers and functions of the LSC ceased to be exercisable by the Commission, except in an appellate capacity. A person who is aggrieved by a decision of a Personnel Board may appeal to the LSC whose decision will be final.

5 Under Article 111AA(6), the President, concurring with the advice of the LSC, approved the appointments to the re-constituted Senior Personnel Board and the Special Personnel Board for a period of three years with effect from 1 December 2007 as follows :

Functions and Duties of the Personnel Boards

6 The re-constituted Senior Personnel Board will exercise the powers and functions of appointment, confirmation/emplacement on the permanent establishment, transfer and promotion over all LSOs at the Timescale grades, including recommending to the Special Personnel Board the LSOs for promotion to the Superscale grade.

7 The re-constituted Special Personnel Board will exercise similar powers and functions over all LSOs at Superscale Grades 4 and 3.

8 The LSC will continue to retain jurisdiction over LSOs who hold appointments of and above the "threshold grade”, which has been designated as LSO Grade 2.

9 The establishment and framework of the Personnel Boards for the Legal Service are prescribed in the Legal Service (Personnel Boards) Order 2007 (“the Order”). 10 The Public Service Commission (Amendment) Act 2007 extends the scope and protection prescribed in the Act (for the PSC) to the LSC and its members and to the Personnel Boards for the Legal Service. Click here to view the Act.
